Same issue as with mist nets. In the end, we'll have to accept that the use of these tools has to be heavily regulated and policed, just as it is now with weapons.
 
In the cases of GPS data being accessed by third parties, I guess that could deplete the batteries in the tags, stopping them from recording more locations, and perhaps preventing researchers from ever downloading the data.
