Sharp shinned hawk? Merlin? (1 Viewer)

Me and my girlfriend are argueing about the ID of this bird.
We spotted it in the Delta area of Vancouver near the coast and marshland. Bear in mind that Merlins on the pacific coast are a darker subspecies. Can anyone help please?

Yeah

Wheatley already said that. It doesn't stop me being surprised at just how dark that race looks!
