Hi, I took this photo in my back yard in south jersey, He is black with a black beak. He has white on his wing, and black feet. Thanks for your help.

When the bird is not displaying, the red part of the wing is frequently covered, just revealing the cream coloured border.

A Tricolored in Jersey? Oh I love you dreamers (heck, I'm one of 'em!). Definitely a Red-winged though - look closer and you can see that it's a pale yellow. Also note shape of coverts and wing-tips (pointer, according to Sibley, on Tricoloreds). To make a case for a Tricolored in Jersey, you'd have to show a lot of evidence, and from what we see here, this is definitely just a typical Red-winged. Don't forget that each bird is an individual, and can sometimes stray a little from the norm (e.g. variant amount of pale yellow on coverts).
