I forgot to mention that this bird was seen on October of 2008. Sorry, been looking through photos and seen this one unidentified. What had me wondering on this bird is the beak..it looks more black and pointed then a Herring or Ring billed but not ruling them out. Maybe it is just because the mouth is open that has me confused. I figure a juvenile or first year bird with coloring.

1st cycle ring-billed gull it is. tail bar looks very solid. it seems that in this ind. the shading towards the base is darker than usual, similar to this maybe: http://www.pbase.com/jpkln/image/86168445 also the rest of the plumage (breast etc.) is pretty strong dark marked for this species. i think the apparently black bill is due to angle and opening it, like you suspected.

some retain most of juvenile plumage well into december, like this: http://www.dpughphoto.com/images/ring-billed gull young edenton 122008.JPG .

this is a pic with too much contrast and prob. altered for use but it still shows a strongly marked (dark) ind. with a solid black tail (how much of it is photo effect?): http://www.baileynaturegallery.com/Ring-Billed-Gull-41797.jpg

but pale grey greater covert bar and contrasting inner primary window (in 1st gen. primaries) is the giveaway for ringbilled here.
