This bird presents a very squat appearance - you can eliminate most grackles on that alone, though not Common Grackle.

When was this photo taken? Could this be an immature bird molting into adult plumage?

A "messy" tail usually makes me think of grackles, but this bird is messy overall.
The black through the eye is good for Rusty, but I'm guessing a mid-molt common grackle could look like that too.

i took the photo on December.

I agree, a Common Grackle, either a female or young male. The beak is, as stated, too heavy for a Rusty, and the lack of rusty tones in the plumage is also wrong for Rusty, in December.
