Its hard to be certain, because its difficult to see the bill. It could be a Worm-eating Warbler, but the dark moustachial stripe might mean that its a Black-whiskered Vireo. The dark legs would also suggest the vireo, as Worm-eating Warbler has pale legs.

To me this is a black whiskered vireo, and that was my immediate reaction even before reading Tom's reply. I have not had much experience with worm-eating, but see BWV regularly. In addition to what Tom said, I would expect that the black mark through the eye would be thinner on the WEW, and that the bill also would give a lighter impression, but mostly I just feel that this is spot on for BWV. IF Sibley's guide is correct, the tail should be a little shorter on WEW.
