Hi Guys, this bird was in Bergen County, NJ today way up in a tree picking off bugs and returning. I thought it was an Eastern Pee Wee until just now when I down loaded my pictures. Now I'm thinking it is an Olive-sided. Opinions please. thanks

Definitely Olive-sided. I'm still waiting to see one this year. I did see an E. Wood-pewee today, and the difference between the two is striking. Your photo shows the bold "vest" with bold white middle area very nicely.
 
Thanks birdmeister, that is what I thought but considering how uncommon they are around here I just wanted to be certain before I post. Thanks again
