Yes. I think that it is a dark morph Short -Tailed Hawk.

As for the possibility of a dark morph Broad-winged Hawk; Wheeler's notes estimate that the dark morph population is less than 1% of the light morph population. See p.250 in the Western Edition; and that sightings of dark morph Broad-winged Hawks are rare to accidental in the east; see page 212 in the Eastern edition.
