If it has all his primaries, yes, but it is obviously moulting

aren't they 2 different birds there? i would go to black for the first 2 photos and red for the last ones

It is one bird in all pictures.

Black for me too. The apparent deeper fork on the last 2 photos is a photo artifact, from dragging/blurring/bleeding (choose your favourite adjective).
