Black-naped, immature? Or is the leg colour wrong?

The leg colour I think would be wrong, secondly despite what the photo shows the black was much more extensive on the nape than a Black-naped. The photo is taken from a dam wall and originally I was over 100m away and looking through bins as I walked along the wall to get closer unfortunately I didn't take photos earlier with a better angle of the head. I got a couple with this angle before something above that it's looking at spooked it.

When walking up to it I'd been thinking it looked a bit like a Common - which is a rare passage migrant here and normally offshore.

This second photo might be the same bird given the time difference is only a few min.
