The only bird I can think of is Chaffinch and I don't know if you get those in America. I don't think anyone else is any closer to getting it either, I'm stumped!

Looks like a small pudgy sort of thing, so I'm going to say Ruby-crowned Kinglet.

Interesting problem.... even though the posture is a little odd, and the bird seems a bit too "skinny" I'm going to go with my first thought; Black-capped Chickadee.
