Thanks Laurent, a very nice find, but unfortunately it doesn't desctibe Captimulgus fossilis. I searched Mlíkovský, 2002 and he states:
Remarks: Jánossy (1977) regarded Čapek's name for this species as unavailable for nomenclatural purposes, probably because it was proposed conditionally. However, such
names are available if published before 1961 (ICZN 1999, Art. 15). In the taxonomic treatment of the form I follow Čapek (1917), and I synonymize accordingly Caprimulgus capeki Jánossy with the modern Caprimulgus europaeus Linnaeus.
So I think the conclusion must be Caprimulgus fossilis, Caprimulgus capeki are both are junior synonyms of Caprimulgus europaeus Linnaeus, 1758.

I must apologize, I missed the german tekst. It is clear he described Caprimulgus europaeus fossilis.

In my notes I have the species as follows:

I'm not really convinced by Mlíkovský's suggestion that Jánossy thought the conditional proposal was a problem, actually -- Čapek also used "fossilis" as an apparent Hungarian word several times in his Hungarian text : I suspect Jánossy read the text in Hungarian, and may rather have perceived the name as vernacular.

Well, Jánossy was a Hungarian, so I suppose he could read the language. I have his 1977 paper, his complete work on the avifauna of the Carpathian basin is great.
