The Richmond Index presents this as "first descr. (but not named)" in : Meyer H von. 1839. Ein Vogel im Kreideschiefer des Kantons Glaris. N. Jahrb. Mineral. Geogn. Geol. Petrefactenkunde, Jahrg. 1839: 683-685.

(I see no real description of the fossil in the 1844 text -- which was largely a complaint by Meyer, about others not attributing the discovery to him --, and Richmond's "first description" -- which is referenced in the OD -- is barely better, actually. It tells us that the fossil had wing and leg bones indicative of a bird; that its feet were not adapted to wading and indicative of the Order "Passerinae"; and that it was the size of a lark. Does this define a new genus and species? Or am I overlooking some obscure reference in the OD?)

You are quite right, but unfortunately it is accepted. It would be better in my opinion just to call it a Nomen Nudum.
