What I was hinting at was that in image 3.4 both birds appear to be pretty much in focus, if the corvid is indeed a carrion/hooded crow then the accipiter is clearly bigger.

Crows habitually mob goshawks in our neighbourhood but largely ignore sparrowhawks except when they are nesting.
 
Just wanted to go the extra mile about it, but yes (barring some strange phenomena) it's very reasonable and useful to assume that.

I recently saw a crow mobbing an accipiter in the city. Not sure what it was but Sparrowhawk more likely on location.
