Looked lika a falcon when flying, but now i don't know.
Maybe a 1 cy Sparrowhawk ? But, no yellow eye.

Eye colour and tail projection (admittedly, the eye colour is just visible in the second picture, not as obvious as it would be in a side view).

The (middle?) toe of which is longer, or do you mean toe length relative to unfeathered tarsus length/leg length?

Length and slenderness is better for Sprawk over Merlin, but yellow eyes and two spots on nape make ID (all on second pic)

Thank you all ! Went back and got better photo (in the same tree). Sparrowhawk it is.
