Malta and hunting policy (1 Viewer)

A poll organised by the Times of Malta found 87% in favour of the Maltese government's decision to suspend the hunting season vs 11% against. A welcome result undoubtedly, but it does rather beg the question of why the Maltese electorate and/or political classes have allowed the hunters' 11% tail to wag the dog for so long.

Malta's Application of Derogation to Permit Live-finch Capturing

The European Commission (EC) has launched infringement procedures against Malta with regards the derogation, from the "Birds" Directive, that Malta will apply to permit limited live-capturing of seven finch species.

Just as it had done in the European Court of Justice Case, European Commission vs Malta (with regards spring hunting), the Federation for Hunting and Conservation - Malta (FKNK) will again offer all its expertise help to the Malta Government in this instance.

This because, the FKNK is aware that:

Malta, being a European Union Member State, has the right to derogate;

Any applied derogation is Member State, species, time, etc., specific;

The derogations contain general criteria that as such are equally applicable in all Member States;

The derogations' application principle, similar to Malta's application, has not seen such EC reaction, even before the actual application of derogation;

Similar derogations, which also permit live-finch capturing, are regularly and annually applied by other EU Member States;

Before it decided to apply the derogation, the Malta Government prepared meticulous and professional studies, both scientific and technical, to ensure that the derogation satisfies all the Directive's parameters and conditions;

Above all, the Malta Government had obtained the Malta Ornis Committee approval to apply derogation, which Committee had gone into great technical detail before it made its recommendation to Government;

Thus, the conditions that:

there is no other satisfactory alternative solution to live-finch capturing;

the numbers that will be taken are very small;

the methods that are used are highly selective;

judicious use is made from the caught birds, that are kept alive in captivity;

strictly supervised conditions will prevail;

will all be met.

I only Lino I remember was the basic floor covering for most people, the one that got dirty from all the crap brought indoors from your footwear, but then, we 'ad it tough in the forties and fifties!

Government May have Succumbed to the Few Individuals

If Government was facing any problems with Local Council Elections, the Federation for Hunting and Conservation - Malta (FKNK), views Government's announcement that next year's Local Council Elections will be held in conjunction with the proposed referendum to abolish the traditional socio-cultural passion of spring hunting, as unethical and hasty. Thus, it may also seem, as if, Government has given-in to the pressure of the few individuals who are proposing the abrogative referendum, which individuals, were they to be genuinely convinced about their proposed abolitionist action, would not have been scared for the referendum to be held separately on its own merits.

Minister Owen Bonnici's press conference of last week, may thus, have also been too rash, since neither the Government, nor the Opposition, nor the Attorney General and nor any other interested party, have as yet, tendered their respective response, to the legal objections that oppose the holding of the proposed referendum, that the FKNK has raised with the Constitutional Court. This, apart from the fact that, the FKNK's objections are still under judicial consideration (sub judice). Consequently, the FKNK is of the opinion, that this action, may, somewhat, influence the responses of the different entities, and maybe, also of the Court itself.

The FKNK also refuses to believe, that, apparently, the Members of Parliament, have decided to completely ignore FKNK's Petition to Parliament, also in opposition to the proposed referendum. In the opinion of the FKNK, the relative Referendum Act, is being used abusively by the few individuals, in order to achieve their personal hidden agenda aim. The Petition, is signed by over 104,000 Maltese and Gozitan citizens, that amounts to one-third of the local eligible voters; by the same Maltese and Gozitans voters who have elected to Parliament, the same Members as their representatives.

The FKNK that has entire trust in the Constitutional Court's wisdom, justice and operating equity, therefore, for the time being, will await the outcome of this Court's decision.

The Sunday Times (of Malta) was asked to publish the English version of the hereunder letter in its issue of Sunday 9th November 2014. However, no explanation was offered for non-publication, notwithstanding two requests that were made to the editor of the newspaper. An abridged version of the letter was published in the daily The Times (of Malta) of Monday 10th November 2014.


"What if?

As part of its EU Membership Treaty obligations, in 2006, Malta transposed the EU “Birds” Directive into local legislation by means of Legal Notice 79.

What if, in the Case of the EU Commission vs Malta (C-76/08) would have been decided by the European Court of Justice (ECJ) precluding completely the practice of spring hunting in Malta?

What if, as a result, the Federation for Hunting & Conservation – Malta (FKNK) would have called on the Maltese Parliament, or one or more of its Members, to hold a referendum to reinstate the practice of spring hunting in Malta, irrespective of the ECJ ruling?

Would not, the answer of the Maltese Parliament, or one or more of its Members, have been that the FKNK cannot expect Parliament, or any of its Members, to overturn and ignore a verdict handed down by the highest EU Institution, the ECJ?

Therefore, also, why have these Members of Parliament, now, apparently, ignored a Petition of the FKNK which carries over 104,000 signatures of Maltese citizens, one-third of the eligible voters, who have voted the same Members to Parliament as their representatives?

However, in 2009, in the Case of the Commission vs Malta (C-76/08) regarding spring hunting, on 10 September, the ECJ ruled that “63 Having regard to those very specific circumstances, hunting for quails and turtle doves during the autumn hunting season cannot be regarded as constituting in Malta, another satisfactory solution, so that there be no other satisfactory solution, laid down in Article 9(1) of the Directive, should, in principle, be considered met.” Thus, the Court confirmed that spring hunting of turtle dove and quail may be permitted on the basis of its finding that the crucial pre-condition for derogations, namely, the absence of an alternative satisfactory solution was met (EU Environment Commissioner, Mr. Janez Potocnik in his answer [E-3349/10EN and E-3357/10EN] to questions in the European Parliament on 26 July 2010). As a consequence, an extremely limited spring hunting derogation has been applied since 2010 in a manner that completely respects the conditions of the “Birds” Directive.

In 2014, an anti-hunting coalition is at present calling for an abrogative referendum to abolish spring hunting.

Should not, therefore, the same answer, in principle, as indicated above, be applied, and the ECJ ruling be fully respected in a manner that completely outlaws the application for an abrogative referendum that is only aimed at overturning and discarding the said verdict handed down by the highest EU Institution, the European Court of Justice?"

BirdLife Malta Still Disrespectful and Unethical


Yesterday, BirdLife Malta (BLM) were up to their old insolent and dishonourable selves, when a handful of 'protesting' BLM activists addressed the media at the entrance of the venue scheduled for the meeting of the Malta Ornis Committee. There, they also handed-over a government confidential document that is still at discussion stage, within the Ornis Committee, to the journalists. This is the umpteenth time that BLM Ornis representatives have maliciously leaked confidential information, from within the Ornis, to the media. One may also conclude that such action could have ulterior political motivations. This, apart from the fact that it is not a finalised document, and is consequently completely misleading to the unqualified general public. The BLM Executive Director, Steve Micklewright, who was one of the handful of 'protestors', mockingly waved his finger at one of the Federation for Hunting and Conservation - Malta (FKNK) Ornis representatives as he was entering the Ornis Meeting's venue.

It is evident that such BLM provocative actions can only lead to confrontation, which may be the easiest way forward for the FKNK, but simultaneously more beneficial, especially financially, to a malicious BLM.

In a further effort to control illegal activities, the FKNK had proposed to government to regularise taxidermy. Against the FKNK's wishes, government opted for its confidential proposal document to be discussed at the Ornis Committee. Yesterday's BLM's unethical and impertinent actions have now proven how correct the FKNK were in their request, simply because BLM can NEVER be trusted.

Furthermore, the FKNK would like to make it very clear that it has never proposed the financial quantum of any proposed fine or fee, but has always left such a delicate issue at government's discretion. Likewise the FKNK is unreservedly against the astronomical fines being proposed in said disclosed document and unlike BLM, who may have wittingly suggested even higher fines, the FKNK will not be making any proposals in this respect.

FKNK’s proposals in bringing up the taxidermy issue was to find a manner by which to curtail illegal practices by targeting actions in a focused manner and in a pragmatic sequence to obtain results. Any other way can only send the art of taxidermy underground to the detriment of wildlife and that of all legal hunters.

Looks like everyone else apart from the ars**** at FKNK are trying to deceive. I wonder who they will blame when there is **** all left to hunt. Not themselves that's for sure !

The Federation for Hunting and Conservation - Malta (FKNK) wishes a prosperous New Year 2015 to its several thousands of hunter and trapper members and their families.

Moreover, the FKNK wants to thank trappers for their beneficial and exemplary contribution, which ensured the correct application of derogations, by means of which a live-bird capturing open season was possible. This, also notwithstanding the provocations and deceitful manoeuvres and misleading publicity to obstruct the derogation's application by groups of persons, organisations and other individuals.

The funny part is that they call people who want to stop spring hunting (particularly referring to Chris Packham) 'pseudo-ecologists' and 'eco-terrorists'. It's so ridiculous.

The fknk also have a bullsh*t argument that other minorities will be targeted after hunting is dealt with. This is of course a massive lie with which they are trying to 'scare' members of other minorities into voting in favor of hunting.

I thoroughly recommend watching the video (especially the interviews with Mr. Farrugia and Mr. Perici Calascione) if you are in need of a good laugh.
