I would have thought that the very fact you would be tresspassing on someone elses land who may or may well not want you there would be legitimate reason. I have to say i find your attitude terrible and its just the sort of I can do what the hell I like approach that can get us all a bad name.

of course you would. but attitudes like yours would haveus all banned from the vast majority of land which britians ramblers and their mass tresspasses into the peak district, gained us all the right to enjoy, rather than just the people with servants and guns

A refreshing streak of realism/honesty, Peter!

I'm not going to admit to anything specific (in writing anyway), but let's just say that I'm sceptical of certain regularly-appalled BirdForum members ("Disgusted of Tunbridge Wells") who presumably behave like saints in everything they do. ;)

 I have never trespassed, flushed a single bird whilst out birding, sworn at idiots with no fieldcraft who have flushed birds, whacked someone with a tripod who stood in front of me or chastised supressors so let me throw the first stone! I have trodden on the gaps between paving slabs though and I once got clocked at 36mph in a 30 limit;)

All I can say is I can only hope that these pathetic wind up attempts and deliberate attempts to try and bring up the dreaded 's' word that I usually get blamed for doing no doubt in an attempt to get me banned by complaining to the mods as soon as I fall for it and reply are met with the same blunt warnings from the Mods that my comments are!

And just for the record going back to the actual topic of tresspassing well I'm not claiming to be an angel by any stretch of the imagination, though it would worryingly seem I'm a lot closer to it than many, like i said before its not so much people doing these relatively minor things now and again kind of knowing its wrong but maybe worth the risk that I object too, what i find rather hard to grasp though is people coming on here bragging about doing it and encouraging others to do it as though we have the god given right to do what we like reguardless of wether the law says otherwise.

You are quite right about the ramblers, but theirs was a considered and well-argued reaction to a perceived injustice. It doesn't equate in any way to a decision taken on impulse to trespass because you feel like it.

This government's initial stumbly approach to privatise Forest Enterprise was rightly perceived as an attempt to make it more difficult to gain access to woodlands; their second attempt is almost as pitiful, but there is at least organised protest. If anyone feels that they should have carte blanche to enter any land whenever a bird they wish to see is on it, then let them organise a campaign to see if they have public support. Any bets on the scale of indifference from non-birders?

One mans' 'trespass' is another mans' 'right to roam' IMO - i am not talking about entering an area during a twitch, just general birding in your local area which is what i mainly do. It is non-destructive and non-littering, i have had countless 'meetings' of the impromptu sort and the bulk of them have ended amicabily and access has been verbally granted to re-visit for most of them. Having a reasonably cheerful demeanour and a set of bins round ones' neck i am sure does help. There is always the odd 'get off my land' which i will willingly do.

What do you see on the beaten track? Plants that are tolerant of trampling and a limited variety of birds......................

I live on the urban fringe in the 'Birddenuded Triangle' of Warks/Worcs/Staffs/WMids so, rightly, a lot of landowners are wary of 'City' folk tramping around due to the very real risk of burglary, theft and rural crime. I just deal with it as and if it happens. If somebody gets arsey and threatens me with the Police the first thing i do is to offer them my mobile phone and suggest that they use it! You can always claim that you are lost - that, fortunately is not a crime.

The law of trespass is an arse and you do not change it by paying credence to it. A large % of farmers and landowners take advantage of taxpayers money to fund their business but wave the Red card when it comes to a bit of access. I tried, last year to get details from DEFRA for owners of set-aside land in my local area, in order to contact them to see if i could record some Winter birds for the BTO atlas - No info was forthcoming despite my requests for legitate legal information. That is the sort of thing that gets up my nose!

Most of the private farm-type land around here is not worth 'trespassing' on anyway, they are Green 'deserts' with knackered hedgerows, no scrubby areas, no wet fields......................nothing.

If you want to see anything remotely of any interest around here you have to visit the concrete puddles they call reservoirs and Nature Reserves run by the local Wildlife trusts and sit in noisy hides. That is not my sort of birding but it's a personal thing and we are all different.

That is why i enjoy 'trespassing'.

Happy birding:t:

Adam,

I really don't understand this post, particularly on this relatively innocuous thread. There've been some strong arguments about trespass but hardly anything about "the dreaded 's' word".
Perhaps it's you who's doing the stirring.

The reason you cant see any posts about the 's' word is that they were deleted when i was given a final warning after apparently a number of complaints all because as i said I had the nerve to reply to other comments where other people had brought the subject up but as usual I got the blame.

As you can see Captaincarot was yet again attempting to turn this into a class issue(though why anyone would think that applies to me when i'm as working class as you can get is beyond me) and quite obviously trying to get me to bite by mentioning 'servants and guns' so i wanted to make the point that i had noticed his comment and dissagreed with it but I'm really unable to comment on the subject as i would most likely get banned from the forum by simply replying to other people's comments, the same people i dare say that wont be warned about their comments the way i am for replying to them and i dare say the very same people who are reporting me to the mods for doing nothing more than replying to their comments that were in all probability only posted in an attempt to get me into trouble in the first place.

I don't understand why people have reported you to the mods, I must have missed something! While I don't agree with your standpoint I've not read anything by you that's O3.

hardly a pathetic attempt, just a statement of fact as recorded by history, possibly you could acquaint yourself, with the mass tresspass of the 1930's, there will after all be rather a large number of events coming next year to celebrate the gains for all achieved by those people 80 years ago.

http://en.wikipedia.org/wiki/Mass_trespass_of_Kinder_Scout a very simple statement of facts, you might also notice, that the people who wrote that historical account , were pathetically attempting to wind you up by mentioning gamekeepers and the trouble that they caused.

or to put it another way, just thought i'd point out the great benefits that you have as a direct result of people who don't think like you fighting against people who do think like you

Mods,

I wonder if you can confirm Adam's statement that you've deleted previous posts on this thread. As a general point, I wonder if you'd consider posting some sort of record when you delete (just a "this post has been removed"). Reading Adam's post, without knowing something has been deleted, does make his views seem a little extreme.

Peter

This is getting very puzzling. What's the 's' word? (if it can't be spelled out without triggering retribution, how about just a hint?)

By bizarre coincidence the 1930s trespasses were mentioned on the drama the Body Farm, which I watched last night. It wasn't really to do with the plot but the character mentioning them linked them with the setting up of the welfare state.

You need a hint? Birdforum.net NOT the hunting/shootingforum.net. Instead of explaining for the umpteenth time, our policy is to just delete post's that discuss shooting, now there are however exceptions which mainly occur in the optics forums when a discussion about scopes and binoculars may go into field craft etc, also there is some slack in the conservation threads, Malta lebanon etc...

But for the most part BF is not a discussion site for shooting.

Hope this is clear.

OK, it's clear - and your point is very strongly made. Please note, however, that your "umpteenth time" is my first.
It's a bit like me having seen my 500th blue crowned motmot and being disparaging about your first view of one.

OK, it's nothing like it, but I hope you get the point.
